Terms of service

These terms govern your use of this store and your purchase of products from ALWAYS GREEN TREE LLC, a limited liability company registered in Missouri, United States. By placing an order you accept them.

Our products

We describe our trees as accurately as we can, including branch tip counts, dimensions and weights. The trees are made by hand in our own workshop, so small variations between individual trees are normal and are not defects. Colours on your screen may differ slightly from the tree in your room.

Our trees are unlit unless the product page states otherwise, and they are made for indoor use.

Prices and orders

Prices are in US dollars and exclude sales tax, which is calculated at checkout from your delivery address. We may change prices at any time, but never after you have placed an order.

Your order is an offer to buy. We accept it when we dispatch your tree. If we cannot fulfil an order, for example because a size has sold out, we will tell you and refund you in full. We may cancel an order where a price or description was obviously wrong, or where we suspect fraud.

Payment

We accept the payment methods shown at checkout. Payment is taken when you place your order, including on orders placed before a shipment has landed. You may cancel before dispatch for a full refund.

Delivery, title and risk

See our Shipping Policy for dispatch times and delivery areas. Title and risk of loss pass to you on delivery.

Limited warranty

We warrant each tree against defects in materials and workmanship for one year from delivery. If a defect appears we will repair or replace the tree or the affected section, or refund you, at our option. This warranty does not cover damage caused by misuse, outdoor use, alteration, or normal wear.

Trade customers

Wholesale and dropship partners are also bound by our MAP Policy and by the terms confirmed in writing when the trade account was opened.

Limitation of liability

To the fullest extent permitted by law, our total liability arising out of any order is limited to the amount you paid for the products in that order, and we are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of Missouri, and any dispute will be brought in the courts of the State of Missouri.

Changes

We may update these terms. The version published on this page when you place your order is the version that applies to it.
